There are actually no laws on the books in regards to spreading out ashes. Ashes can be stored any way you like, as well, as there is nothing about ashes that are any kind of hazard.

Every Montanan knows that it's always a good idea to make sure you have permission from the land owner (private or government) before scattering anything.  It's just common courtesy.

The Living Urn Highlights These Ash Scattering Favorites:

  • Public Land: With so much beauty in Montana, almost anywhere would be great.  Just check with local officials
  • Private Property: It should go without saying that you should ask before you scatter ashes on someone's land, no matter how much you love it.
  • Federal Land: If you're planning on scattering ashes in one of Montana's many national parks, it's a good rule of thumb to check with the Park Ranger.  You may need a permit.
  • Scattering Garden: Typically in a cemetery, memorial park or church, you may see designated areas for ash scattering.  Your funeral home should be able to inform you on where there is a scattering garden in your area.
  • Water Burial: Federal law says you need to be, at least, 3 nautical miles from shore, and you need to notify the EPA 30 days out.
  • Aerial Scattering: Avoid populated areas, and, of course, do not throw out the urn.  You could kill someone or cause property damage.
