Gun Laws Differ From State To State
When it comes to gun laws, however, not every state plays by the same rules, particularly regarding who can and can’t own a firearm.
These laws are often called “red flag laws” or extreme risk protection orders.
The theory is if a person is believed to be a danger to themselves or others, a judge can order their guns to be removed for a period of time. In most cases, the request comes from the police or close family members.
Why Knowing Your State’s Gun Laws Matters
Supporters of these laws look at them as prevention. Removal of firearms could prevent a tragedy from happening, either from self-harm or from violence towards others.
Opponents, on the other hand, ask about due process. They argue that these laws can be abused with guns removed before the owners can defend their constitutional rights in court.
